By accessing and using Louer ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Louer is a peer-to-peer marketplace platform that enables users to rent and list fashion items. We provide the platform and tools to facilitate transactions between users, but we are not a party to the actual rental agreements between users.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. User Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• List counterfeit or stolen items
• Engage in fraudulent activities
• Harass, abuse, or harm other users
• Interfere with the proper functioning of the Service

5. Listings and Rentals

When listing items, you represent and warrant that:

• You own the items or have permission to rent them
• Items are accurately described and photographed
• Items are authentic and not counterfeit
• Items are in the condition stated

When renting items, you agree to return them in the same condition, within the agreed timeframe, and to pay all applicable fees.

6. Payments and Fees

All payments are processed securely through our payment processor. We charge a service fee on each transaction. Listers receive payment after the rental period is complete and the item is returned in acceptable condition.

7. Cancellations and Refunds

Cancellation and refund policies vary depending on timing and circumstances. Please refer to our Help Center for detailed information about cancellations and refunds.

8. Damage and Loss

Renters are responsible for any damage to rented items beyond normal wear and tear. We provide damage protection coverage for qualifying rentals. Claims must be reported within 24 hours of return.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Louer and are protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

Louer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid to us in the past twelve months.

11. Indemnification

You agree to indemnify and hold harmless Louer and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
